The entitlement to a mark is the exclusive right of the owner
According to the Swiss Trademark Act, the owner of a trademark is entitled exclusively to dispose of it and to use the mark for the purpose of designating the goods or services for which it is registered. This exclusive right gives the owner the authority to dispose of the trademark and to prevent third parties from using marks identically or confusingly similar to his own mark. The trademark owner may only proceed accordingly, as long as the defended mark is effectively used on the market.
