Swiss Federal Patent Court

The Swiss Federal Patent Court (Bundespatentgericht, Tribunal fédéral des brevets, http://www.bpatger.ch) has become effective on 1 January 2012. Since then it is the only court of first instance ruling on civil law disputes concerning patent infringement and validity in Switzerland. The Federal Patent Court is also responsible for the issuance of preliminary injunctions in patent matters, as well as for other civil law disputes related to patents, such as license contracts and patent ownership questions. Judgments of the Federal Patent Court can be appealed to the Swiss Federal Tribunal (the Swiss Federal Supreme Court), which is the second and last instance.

The Federal Patent Court comprises the President of the Court, the Vice President, and one full-time Technical Judge, as well as a pool of supplementary (non-permanent) judges, including so called technical judges, being trained in various technical disciplines, which are called in according to the requirements of a certain case. The concentration of all patent law suits in Switzerland to a single, specialized court as well as the use of technically trained judges shall make law suits in patent matters in Switzerland considerably more efficient in the future.
